3. le Client Taiga Zone insiste fortement sur l importance d observer les directives et conseils d entretien consign s dans le Guide pour l entretien du bois de votre piscine en c dre et incite le Client suivre les cours sur l ouverture l entretien et la fermeture des piscines offerts par les d taillants En particulier mais sans restreindre la port e de ce qui pr c de on porte l attention du Client les dommages suivants qui r sultent d un entretien fautif dont la responsabilit incombe enti rement au Client tout dommage occasionn par un hivernage d fectueux par une eau de mauvaise qualit ou d acidit lev e par une piscine laiss e vide par la vidange de la piscine et par un mauvais entretien du bois de la piscine Comme indiqu sur le contrat d achat du Client si le Client a omis de faire les choses suivantes contrairement aux recommandations faites les dommages qui pourraient survenir au bois pourriture moisissure etc de la piscine ne seraient nullement couverts par cette garantie Teindre le bois de la piscine d un seul c t soit le c t ext rieur afin de laisser respirer le bois et ainsi viter de le faire pourrir ou moisir Apr s l installation de la piscine disposer une toile g otextile et de la pierre ou des galets de rivi re par dessus la toile tout le tour de la piscine et ce sur une largeur de douze pouces et rien d autre dans ce p rim tre de douze pouces aucune planta
4. of God or force majeure such as but not limited to lightning flooding the overflow of moving or stationary bodies of water earthquakes shifting soil or unusual climatic conditions such as a deep freeze or heavy downpour e Damage to the installation caused by the inadequate care and improper use of the pool as well as by removals modifications or additions carried out by the Customer Taiga Zone strongly emphasizes the importance of complying with the maintenance tips and instructions found in the Maintenance Guide for your Cedar Pool s Wood and encourages the Customer to take the pool opening maintenance and closing classes offered by the pool Retailers In particular but without limiting the scope of the preceding Customer is made aware of types of damage resulting from improper care that are the responsibility of the Customer these include damage caused by improper winterizing poor water quality including acidity outside the acceptable range leaving the pool empty improper drainage and inadequate care of the wood As stated on the Customer s purchase agreement if the Customer has failed to do the following contrary to the recommendations made any damage that may occur to the pool s wood rot mold etc would not be covered by this warranty Stain the wood on the outside only to allow wood to breathe and avoid mold or rot After the pool s installation put a geotextile fabric and stone or river pebbles over the canvas

8. ernant les dommages caus s par des Conditions Exceptionnelles entre en vigueur la date d achat indiqu e au contrat d achat de la piscine et expire la fin de la cinqui me ann e suivant la date d achat D s l expiration de la garantie Ta ga Zone est d s lors d gag e de toute responsabilit en ce qui concerne tout dommage usure r parations ou remplacement aux Composantes caus s par des Conditions Exceptionnelles et le Client doit d s lors assumer tous les frais relatifs aux r parations et remplacements des Composantes quelles que soient les causes et circonstances menant de tels r parations ou remplacements Signalement de possible dommage caus par des Conditions Exceptionnelles 4 Le propri taire de la piscine doit signaler imp rativement et promptement par crit au d taillant qui lui a vendu la piscine de c dre Ta ga Zone ci apr s d sign le D taillant toute anomalie ou particularit d une Composante qui pourrait indiquer un possible dommage caus par des Conditions Exceptionnelles le propri taire de la piscine doit fournir au D taillant une description d taill e avec photographies l appui de l anomalie particularit ou dommage constat Tel signalement doit parvenir au D taillant au plus tard deux semaines apr s la premi re apparition de l anomalie particularit ou dommage apparent Tout retard dans le signalement aura pour effet d annuler la Garantie Sp ciale ou d en r duire l ap
9. hall be paid to Taiga Zone before the start of the work and the balance of the amount of the estimate shall be paid to Taiga Zone upon the completion of the work Repairs carried out to repair damage due to Exceptional Conditions do not result in an extension of the Special Warranty period 7 Repairs carried out to repair damage due to Exceptional Conditions do not result in an extension of the Special Warranty duration referred to in section no 3 Appearance of Parts following repair 8 Taiga Zone will make every effort to preserve the appearance prior to repair of the Parts but is unable to warrant to the Customer that it will be able to do so Special Warranty exclusions 9 The following instances of damage deterioration and breakage are not caused by Exceptional Conditions and shall in no way impose any liability on Taiga Zone a Damage caused to the installation by defects in the materials and equipment furnished and installed by the Customer that prevent hinder or interfere with the pool s normal operation b Damage caused to the installation by a significant amount of accumulated water in the ground the effect of keeping a pool entirely empty or a deep freeze c Damage resulting from an installation performed by the Customer or the Customer s agents that fails to comply with Taiga Zone standards as described in the nstallation Manual and the Use and Maintenance Guide d Damage to the installation resulting from an act
10. ie Sp ciale Adduction d eau et de produits chimiques 11 Taiga Zone n assume pas les co ts d adduction d eau et de produits chimiques y compris le sel lors de l installation de la piscine et n assume pas non plus de tels co ts s il est n cessaire de remplir une piscine qu il a fallu vidanger pour effectuer des v rifications de l entretien ou des r parations Autres conditions affectant la garantie 12 L application de la garantie est suspendue tant que le Client a des obligations financi res en souffrance envers Taiga Zone et reste suspendue tant qu il ne s est pas acquitt compl tement desdites obligations financi res Aucune autre garantie ou entente expresse tacite verbale ou crite 13 Cette garantie conf re aux Clients de Ta ga Zone des droits particuliers pr cis s dans ce document et sauf ceux ci Ta ga Zone ne donne aucune autre garantie expresse tacite verbale ou crite Ta ga Zone et le Client conviennent que ce document renferme tous les termes et conditions de la garantie et qu aucune autre entente crite verbale ou implicite concernant la garantie n a fait l objet de discussion ni n a t prise par Taiga Zone et le Client Cession de la garantie 14 Cette garantie peut tre c d e tout nouvel acqu reur de la propri t o est situ e la piscine pourvu qu une inspection technique faite par Taiga Zone conclut au bon tat de la piscine Le co t de l inspection et de l ouverture du
11. liner pipes and various related parts skimmer water return diversion valve and other accessories Warranties covering manufacturing defects in accessories acquired by the Customer are the responsibility of the manufacturers of such accessories The Customer is asked to address any claims for items covered by a warranty to the respective manufacturer Taiga Zone s Special Warranty in respect of Parts affected by Exceptional Conditions 2 For the purpose of the Special Warranty damage to Parts referred to in Section no 1 caused by Exceptional Conditions provided that the damage in question is one that a severely impairs the quality safety or use of the pool or b makes the pool unsuitable for its intended purpose or greatly diminishes its usefulness or c affects a critical Part among those listed in Section 1 such that the solidity of the installation is compromised will be repaired by Taiga Zone at its own expense provided also that such repairs take place during the duration of the Special Warranty referred to in section no 3 and in accordance with the other terms and conditions set out in this Special Warranty However damages and deterioration referred to in section no 9 which do not result from Exceptional Conditions are excluded from the Special Warranty Duration of Taiga Zone s Special Warranty in respect of damage caused by Exceptional Conditions 3 Taiga Zone s Special Warranty in respect of damage caused by Exceptional Co
12. nditions takes effect as of the date of the purchase contract and expires at the end of the fifth year following the date of the purchase contract As of the expiration date of the Special Warranty Taiga Zone is relieved of any responsibility in respect of any damage wear repairs or replacement of Parts damaged by Exceptional Conditions and the Customer must from that point on assume all costs related to the repair or replacement of Parts regardless of the causes and circumstances leading to such repairs or replacements Notification of any possible damage caused by Exceptional Conditions 4 It is imperative that Customer notify the Retailer who sold the pool hereinafter referred to as the Retailer promptly and in writing of any anomalies or particularities that could indicate a possible damage caused by Exceptional Conditions The Customer must provide the Retailer with a sufficiently detailed description along with supporting photos of the observed anomaly or particularity The Retailer must receive such notification within two weeks following the appearance of the observed anomaly or particularity Any undue notification delays will void the warranty or reduce its scope Upon receiving the notification the Retailer will review the situation and inform the Customer whether damage resulting from Exceptional Conditions has been found or not and if applicable will inform the Customer of any repairs to be made If the Customer is unable t
13. o perform inspections maintenance or repairs Other conditions affecting the Special Warranty 12 The Special warranty is suspended during the period in which the Customer is in default on debts owed to Taiga Zone and will remain suspended as long as said debts have not been settled in full No other express tacit verbal or written warranties or agreements 13 This Special Warranty grants Taiga Zone s customers particular rights as detailed in this document and beyond these Taiga Zone does not provide any other express tacit verbal or written warranties Taiga Zone and the Customer agree that this document includes all warranty terms and conditions and that no other written verbal or implicit agreements regarding the warranty were discussed or made by Taiga Zone and the Customer Warranty transfer 14 This warranty may be transferred to any new buyer of the property on which the pool is located provided that a technical inspection performed by Ta ga Zone determines the pool s soundness The cost for the inspection and starting a new file shall be paid in advance by the Customer and is not reimbursable NOTE The underlining of words in the section headings is intended strictly to facilitate the reading of this document and shall not be interpreted in any other way Modifi e 21 01 2014
14. o provide a detailed description of the anomaly or particularity along with supporting photos the Customer may request the assistance of the Retailer technician In this case the Customer will be charged for any travel costs Repairs of damage to one or several Parts caused by Exceptional Conditions 5 If the review of the notification referred to in section no 4 concludes that it is necessary to repair damage to a or several Parts which damage is due to Exceptional Conditions and if the repairs are undertaken during the duration of the Special Warranty referred to in section no 3 such repair to the Part or Parts and only such repair will be at the expense of Ta ga Zone Work other than required by the repair of damage due to Exceptional Conditions 6 In the event that the repairs of damage due to Exceptional Conditions require the moving modification to or repair of structures of earthwork of landscaping or of Parts other that those due to be repaired as referred to in section no 5 the cost of moving modifying or repairing such structures earthwork landscaping or Parts other than those due to be repaired shall be assumed by the Customer If the Customer wishes to retain the services Modifi e 21 01 2014 of Ta ga Zone to carry out work other than that required to repair the Part or Parts damaged as a result of Exceptional Conditions Taiga Zone shall submit a cost estimate to the Customer One half of the amount of the estimate s

16. plication Sur r ception du signalement d taill et des photographies le D taillant fera une analyse appropri e du dit signalement et informera le propri taire de la piscine si la Composante en question pr sente ou non un dommage attribuable des conditions exceptionnelles survenues pendant la dur e de la Garantie Sp ciale et s il y a lieu linformera aussi de la r paration qui doit tre effectu e pour r parer ledit dommage Dans ventualit o le Client ne pourrait lui m me fournir une description d taill e du dommage apparent avec photographies l appui le propri taire de la piscine peut demander l intervention du technicien du D taillant et dans ce cas des frais de d placement seront factur s au propri taire de la piscine R paration de dommage une ou plusieurs Composantes attribuable des Conditions Exceptionnelles 5 Lorsque l tude du signalement dont il est fait tat la section no 4 conclut qu une r paration pour corriger un dommage une ou plusieurs Composantes dommage attribuable des Conditions Exceptionnelles est n cessaire et lorsque telle r paration est entreprise au cours des cinq ann es de la Garantie Sp ciale dont il Modifi e 21 01 2014 est fait tat la section no 3 telle r paration la ou aux Composantes endommag es et seulement la r paration cette ou ces Composantes sera enti rement la charge de Ta ga Zone Travaux autres que ceux exig s pour r
17. res Les garanties pour les accessoires acquis par le Client rel vent des manufacturiers de tels accessoires Le Client doit s adresser aux manufacturiers pour toute r clamation qui serait sous garantie Garantie Sp ciale de Taiga Zone concernant les Composantes endommag es par des Conditions Exceptionnelles 2 Aux fins de cette garantie tout dommage aux Composantes dont il est fait tat la section no 1 caus par des Conditions Exceptionnelles lorsque ce dommage i porte une s rieuse atteinte la qualit la s curit ou l utilisation de la piscine ou ii rend la piscine impropre l usage auquel elle est destin e ou diminue gravement son utilit ou iii affecte une Composante importante qui compromet la solidit de la construction sera r par par Ta ga Zone et ses frais sous r serve des termes et conditions indiqu s dans la pr sente Garantie Sp ciale Toutefois les dommages et d gradations dont fait tat la section no 9 Exclusions de la Garantie Sp ciale ne r sultant pas de Conditions Exceptionnelles survenant pendant la dur e de la pr sente Garantie Sp ciale dur e dont il est fait tat la section no 3 de la pr sente Garantie Sp ciale sont exclus de la garantie concernant les Composantes et n engagent nullement la responsabilit de Ta ga Zone Dur e de la garantie de Ta ga Zone concernant les dommages caus s par des Conditions Exceptionnelles 3 La Garantie Sp ciale de Taiga Zone conc
