7. g prices for added Equipnrent or Services 4 Tem For other accounts the Services will be provided for each period for which custorrer is billed or charged until tenrinated in witing by either party no less than 30 days prior notice Notwithstanding the foregoing Anbi ent may suspend Custorrer s service without prior notice in accordance with sections 8 or 10 of this agreerent After activation neither Antbient nor any retailer will issue Custorrer credit for used or unused Services for which payrrent has been received 5 No Proprietary Rights Custorrer has no proprietary right to any unique identifier nuntber capcode transmission method or nicropacket offset assigned to said Custorrer Ambient may alter any such value a necessary to comply with laws regulations or in the course of business 6 Repairs Arrbient will repair or replace at no cost to Custorrer any Equiprrent that malfunctions during nomal use for reasons other than abuse or darmmage including weater darrage in the first 30 days after the date of pur chase Custorrer must notify Ambient of the malfunction within such period and deliver the Equipment to Ambient in accordance with its instructions 7 Risk of Loss Custorrer bears all risk for lost danaged or stolen Equipnrent If offered by Ambient Custorrer may enroll the Equipment in Arrbient s Pager Loss Protection Program upon Ambient s standard tents and conditions for the Program 8 Default by Customer

9. le or as to a specified part of the Equipment and Services The rerredy provided in this Section is Custorrer s sole rerredy for Anbients failure to performany obligation 10 Exclusive Use Custorrer agrees that the Equipnrent and Services will not be used in any way which i is unlawful fraudulent excessive or abusive or ii interferes with Ambient s ability to provide service to its Customers or iii darrages Ambient s property Custorer will not use profane abusive or harassing language when using inquiring about or ordering Equipnrent and Services If this Section is violated then Ambient may intrediately and without notice suspend all or any part of the Services and or upon 30 days notice to Custorrer terminate this Agreerrent 11 Denial of Service If Armbient detenrines that Custorrer is excessively using the Services or is in any way causing an unreasonable burden on the Ambient Infomation Network Anbient shall have the right to assess usage or other charges or otherwise modify Custorrer s pricing 12 Disclairrer of Warranties Custorrer acknowledges that i Anbient is not the manufacturer of the Equipment nor the manufacturer s agent and ii Anbient has not made any representation or warranty regarding the Equipnent or Services not contained herein and iii Custorrer is responsible for reading the operating instructions and wamings provided by the manufacturer of the Equipment and iv the Equipment is manufactu
10. ount of usage which will be charged in arrears plus taxes and assessrrents Custorrer s payment is due in full without discount or offset a for billed accounts 30 days after the invoice date and b for all other accounts on the date Charged Custorrer will be charged for Services whether or not suspended for all billing periods during which a telephone number or personal identification number is assigned to Custorrer Custorrer s payment for Equipnrent purchased directly fromAmbient is due in full when shipped or delivered whichever occurs first Anbient may Charge custorrer interest on any balance not paid within 30 days after the due date at the lesser of i 1 5 per month or ii the meaxinumrate penrvitted by lav fromthe due date until paid Custorrer waives any right to dispute any Charge unless Custorrer notifies Anbient of the dispute within 30 days after receipt of notice of the Charge If a check is retumed to Ambient marked unpaid Cus toner will pay Armbient s then applicable retumed check fee which will be at least 20 Custorrer authorizes Ambient to charge delinquent payrrents to Custorrer s credit card account Custorrer will pay Anbients Standard list prices in effect fromtine to tire 3 Changes in Services or Equipment Arrbient may add delete or modify Equipment or Services at any tine including Changes that may affect the coverage area of the Services Ambient will make infomation thereof available to Customer includin
